Terms and Conditions

Rent

The Lessee shall pay a pre-determined security deposit due upon signing, and will pay a pre-determined monthly fee plus GST for the advance rental of the property due and payable on the 1st of the month. Payments may be made by cheque, debit, Visa, MasterCard, or Etransfer.

Upon payment of any funds the Lessor will provide a receipt of payment to the Lessee no later than 5 days from payment.

In the event the Lessor does not receive rent for a given month within 3 days of the payment’s due date, the Lessee will be charged a late fee of $25.00. In the event of a returned check the Lessee shall pay a $25.00 return check fee.

In the event that rent is not paid by the 7th of the month, the rental agreement is immediately terminated. Upon termination, the security deposit will be forfeited and the Lessee has 7 (seven) days to remove all personal property from the premises. Any property remaining on the property past the 14th of the month shall become the property of the Lessor *Vehicles will be towed to Westshore Towing storage lot. No further notice of termination will be given.

Use of Premises

Lessee shall use the storage unit for storage purposes only and will not store live animals or perishable goods inside the premises.

Lessee will not store in the storage unit hazardous materials including, without limitation, substances that are toxic, reactive, flammable, explosive, hazardous or corrosive.

Lessee acknowledges that the storage unit is not be used as a dwelling, place of business, or for any purposes other than storage of personal property.

The Lessee may not store anything outside of the secure storage container provided. Illegal activities and items are prohibited on the premises at all times.

Personal Property

The property inside the storage unit is the sole responsibility of the Lessee. The Lessor does not assume or imply responsibility for the Lessee’s property at any time. The Lessor will hold no liability for any damages that may incur from the items being stored on the property for any reason.

Maintenance

The Lessee will keep the rented storage unit in clean and well-kept condition at all times during this storage rental agreement.

Should periodic maintenance or repairs be necessary, the Lessor agrees to notify the Lessee 24 hours prior to making such repairs.

Governing Law

This rental agreement shall be subject to the jurisdiction of Victoria, BC. Furthermore, both parties agree to seek mediation prior to any legal proceedings taking place.

Security and Liability

The Lessee understands there will be no provided security for the storage unit and all property stored will be under the sole liability of the Lessee.

The Lessor will not be responsible for any loss, or damages that may incur from the storage of property.

Damages

Lessee agrees to be held solely responsible for any damages to the rented storage unit beyond normal wear and tear, as defined by law.

Lessee agrees that no permanent fixtures or shelving shall be installed in the storage container. Any and all damage to containers will be charged back to Lessee.

Should damage beyond wear and tear be discovered, the Lessee agrees to pay for such damages prior to retrieving their property from the storage unit or their security deposit will used to cover the costs of repair.

Termination

Either party may request the termination of this agreement with 15 days prior notice. Notification must be made before the 15th of the month providing a full 15 days notice. All personal property must be removed by the last day of the month. Upon removal, security deposit will be returned within 3 days. If items are remaining in the storage unit on the first of the month, another month’s rental becomes due and payable.

Amendment

This storage rental agreement may not be amended, redacted, or otherwise altered except through written amendment signed by both parties.

Severability

Any article of this storage rental agreement deemed unenforceable, illegal, or unfair by a court of law shall be replaced by an acceptable article accomplishing the same basic goal of protecting both parties and their rights as they relate to this storage rental agreement.

If any terms or conditions in this storage rental agreement are found to be unenforceable all remaining terms and conditions will remain in full effect.
